Edisfera Srl informs you that the data required, and that you voluntarily provided, by the contact form, by signing up our newsletter and by booking procedure of www.welcomesailor.com, will be processed in compliance complying with Article 13 of the Decree of Law 196/2003 (Privacy Code concerning the protection of personal data), with Article 13 e 14 of GDPR Regulation EU 2016/679 and of Measures regarding Cookie n.229, 05/08/2014.
The indications given in the following report are motivated by the guide lines given in art. 29 of the directive n. 95/46/CE and, in particular, are in relation to the collecting of personal data on the internet; with the intent to identify the measures that should be taken by the persons involved, to guarantee the loyalty and legitimacy of the method (on application of Art. 6, 7, 10 & 11 of the directive 95/46/CE).

Manner and purposes of data-collecting

The purpose of this section is to notify you about the manner and the purposes by which Welcome Sailor may collect and transfer certain personal information. This privacy policy should be read in its entirety because anyone who submits personal information to Welcome Sailor has certain rights regarding the use, collection and transfer of such personal information.

Welcome Sailor maintains a centralised reservations system through a worldwide accessible website. The central reservations system is maintained for the benefit of Welcome Sailor member marinas. Through the website and the reservation system, Welcome Sailor may collect certain personal information from users, an example of which are the contact details, the signing up our newsletter and the payment information of those customers wishing to make a reservation at Welcome Sailor member marinas. Also, yachters personal Information is collected to make possible the reservation at Welcome Sailor member marinas.

Welcome Sailor will collect yachter personal information for the following purposes:

  • transmit data to the Welcome Sailor member marina so that it can honour the reservation;
  • allow marina to access its reservations data;
  • notify the booking confirmation to users;
  • allow users to access their reservations in order to make cancellations, changes or to simply review them;
  • produce marketing statistical analysis;
  • send newsletter.
Data might be processed in collaboration with third parties specifically selected by Welcome Sailor for this purpose and anyhow linked to Welcome Sailor by a relationship of employment, collaboration or consulting. 

Welcome Sailor may send you newsletters about Welcome Sailor or its member marinas, offers, information, products and services.

Data retention policy

Yachters Personal Information will be transferred from Welcome Sailor to Welcome Sailor member marinas and will be stored in the reservation system up to the departure date or to satisfy contractual obligations between Welcome Sailor and the member marinas or to fulfil any legal obligation. Afterwards, the personal data in the reservation will be cancelled and bookings will be stored in an aggregated manner so that each reservation won't have any reference to the yachter.

Communication and dissemination of personal data

Personal data will not be communicated to other subjects, nor they will be subject to disclosure, unless differently stated by the contract or expressed consent of the user. Welcome Sailor may disclose your personal data to third parties when there is a reason to believe that it is necessary to identify, contact or bring legal action against people or entities who may be causing injury to you, to Welcome Sailor or to others. We may also disclose your personal information to third parties when it is required by the law.

Provision of personal data

The personal data requested in the form it may be necessary to complete the booking or registration and, therefore, are mandatory or optional. The mandatory or optional is specified from time to time during the collection of individual data. If the provision of data is required, the refusal to provide the requested data will make it impossible to refine the procedure attached to the form for which the data are required. If the provision of data is optional, the refusal to provide the requested data will have no consequence in relation to the proper end of the procedure connected to the form for which the data are required. When you provide us with personal information to complete a transaction, verify your credit card, place a booking order, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. If after you opt-in, you change your mind, you may withdraw your consent for us revoking it at any time by the unsubscribe link within the communications.

Place of processing of data collected

The data are processed at the place of business of the Owner and the Controller and any other place where the parties involved in the treatment are localized.

Transmission of data

The Owner of the service will not transmit personal data to third countries or international organizations. In any case, they reserve the possibility to use services in cloud, in this case, the service providers will be selected among those who offer adequate guarantees, as foreseen in Article 46 GDPR 679/16.

Welcome Sailor informs that any personal data that may reveal racial or ethnic origins, religious views, philosophical or other type of opinions, political beliefs, accession to political party or trade union, as well as data concerning the state of health or sexual behaviour are considered sensitive data. Those data, voluntarily provided by you, will not be processed without your express written consent and will be processed as stated by the legislative decree 196/2003.

Welcome Sailor website may contain links to websites operated and maintained by third parties, over which Welcome Sailor has no control. The privacy policies of this linked sites may differ from the Welcome Sailor one. You access those linked sites at your own risk. Welcome Sailor undertakes to protect the security of the user's personal data and complies with the security provisions established by applicable law to avoid data loss, illegal use of data and unauthorized access to them, with particular but not exclusive reference to Annex B of the Privacy Code (Technical Disciplinary regarding minimum security measures) and pursuant to art. 25-32 of Regulation 2016/679 / EU.

Welcome Sailor constantly conducts internal surveys on its data collection and processing practices and on the adopted security measures, so that those security measures could provide reasonable level of precaution against the unauthorised access, disclosure, alteration or destruction of the Personal Information that Welcome Sailor collects.

Welcome Sailor has also conducted an internal review of its computer network and its data protection measures and believes that it has implemented a reasonable level of technology and software to protect against the loss of Personal Information. Such measures include, without limitation, the following: the use of several firewalls to separate user network traffic from server network traffic; the use by the Welcome Sailor web applications of SSL encryption whenever sensitive information is being accessed; the use of virus protection software on Welcome Sailor's e-mail servers and client computers.

Data integrity

Welcome Sailor only collects or processes Personal Information which is required in order to provide services for or to fulfill its contractual obligations with yachters and Welcome Sailor member marinas.

Access, change and cancellation data

Welcome Sailor allows yachters, of whom Welcome Sailor collects Personal Information, to review their Personal Information and reservations made through the Welcome Sailor website. The Personal Information provided during the reservation process can be changed or cancelled by the yachters through the cancellation and change booking functions listed in the Welcome Sailor website menu.

Revoking consent

Under Article 23 of Legislative Decree 196/2003 and Article 6 of GDPR 679/16, the concerned party may revoke consent at any moment.

Rights of the concerned parties

With reference to Article 7 of Legislative Degree 196/2003 and Articles 15 Rights of access, 16 – Rights of rectification, 17 – Rights of cancellation, 18 – Rights to limitation of handling, 20 – Rights of portability, 21 – Rights of opposition, 22 – Rights of opposition to automated decision processes from GDPR 679/16, the concerned party exercises his/her rights by writing to the Owner of the service at the address listed, or by email to privacy@welcomesailor.com, specifying the subject of his/her request, the rights that he/she intends to exercise and attaching a photocopy of the ID document that certifies the legitimacy of the request.

Owner of the Personal Data Processing concerning reservations is the booked Welcome Sailor member marina. Data controller of personal booking data and other www.welcomesailor.com procedures is Edisfera Srl. For all matters regarding the processing or diffusion of your data, please contact the Controller by writing to privacy@welcomesailor.com. With reference to the personal data collected by the booking system of Welcome Sailor, any decision about the purpose and manner of the used tools for data collection, including the security of those, is in the attribution of the Controller of processing.

Complaint proposition

The concerned party has the right to submit a complaint to the controlling authority of the state of residence.

Automated decision-making process

The Data Owner and Controller do not execute handling of registration data that consists in automated decision-making processes.

The Data Owner and Controller reserves the right to make changes to this privacy policy at any time by giving notice to its Users on this page.
